form, cut, crushed, or powdered, regardless of whether the opium juice
has been extracted.

Any person who does the following without legal
authorization or in violation of licence conditions is guilty:

· Transports

or exports inter-State
· Sells
or purchases
· Uses
· Fails
to warehouse or unlawfully removes warehoused poppy straw
Punishment Based on Quantity

- Small Quantity (below 1 kg):
- Rigorous imprisonment up to 1
year, or
- Fine up to ₹10,000, or both.
- Intermediate Quantity (1 kg to 50
kg):
- Rigorous imprisonment up to 10
years, and
- Fine up to ₹1,00,000.
- Commercial Quantity (above 50 kg):
- Rigorous imprisonment of not less
than 10 years, extendable up to 20 years, and
- Fine between ₹1,00,000 to
₹2,00,000.

- Small Quantity
Ramesh, a villager, was caught carrying 800 grams of powdered bhuki for selling in a local fair without a valid licence. Since the quantity is below 1 kg, he faces punishment of up to 1 year imprisonment or a fine of ₹10,000.
- Intermediate Quantity
In Madhya Pradesh, police caught a truck driver transporting 20 kg of poppy straw to another state. Since the quantity lies between 1–50 kg, he may face up to 10 years of rigorous imprisonment along with a fine of ₹1,00,000.
- Commercial Quantity
A gang was intercepted with 120 kg of poppy straw stored in a warehouse. As this is above 50 kg, it qualifies as a commercial quantity. The offenders are liable for 10–20 years of imprisonment and a fine ranging from ₹1–2 lakh.
Section 16: Punishment for Contravention
in Relation to Coca Plant and Coca Leaves

Definition of Coca Leaf [Section 2(vi)]
- Refers to the leaf of the coca
plant, except when all cocaine and related alkaloids are removed.
- Includes mixtures (with or without
neutral material).
- Excludes medicinal preparations with not
more than 0.1% cocaine.
Definition of Coca Plant [Section 2(vii)]
- Any species of the Erythroxylon
genus.
Acts Considered Offences
Any person who, in contravention of the Act:
- Cultivates coca plant
- Gathers leaves or any portion of the
plant
- Produces, possesses, sells,
purchases, transports
- Imports or exports inter-State
- Uses coca leaves

- Illegal Transport
A businessman in Maharashtra was caught transporting 5 kg of coca leaves hidden inside sacks of tea leaves. Since possession and transport without licence are prohibited, he became liable to face up to 10 years imprisonment and a fine up to ₹1,00,000.
Section 17: Punishment for Contravention
in Relation to Prepared Opium

Definition of Prepared Opium
As per Section 2(xvi)(b):
- Any product of opium processed
through operations to make it suitable for smoking.
- Includes dross or residue left
after opium is smoked.
Acts Considered Offences
Any person who illegally:
- Manufactures
- Possesses
- Sells or purchases
- Transports
- Imports or exports inter-State
- Uses prepared opium

- Small Quantity (below 1 kg):

Police raided a lodge in Bihar and found 15 kg of prepared opium hidden in a room rented by smugglers. This falls under the 1–50 kg range, making them liable for up to 10 years imprisonment and ₹1,00,000 fine.
- Commercial Quantity
In Rajasthan, enforcement agencies busted a cartel possessing 80 kg of prepared opium. Since this is more than 50 kg, the accused must undergo at least 10 years (extendable to 20 years) of imprisonment and a fine between ₹1–2 lakh. The judge even has the discretion to increase the fine beyond ₹2 lakh with proper justification.
